Acceptance of Terms These Terms and Conditions ("Terms") govern your access to and use of the website at corefunctionhealth.com (the "Site") and any related online services provided by Core Function Health Physician Assistant Corporation ("Core Function Health," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. ## 2. About Core Function Health Core Function Health Physician Assistant Corporation is operating in the State of California under the medical supervision of a licensed California physician. Clinical services are offered only to adult patients physically located in California at the time of their appointment, in accordance with California medical practice laws and regulations. We are a cash-pay specialty wellness practice. We do not accept, bill, or participate in any health insurance plans. ## 3. Eligibility You must be at least 18 years old to use the Site or engage clinical services. By using the Site, you represent that you meet this age requirement. Clinical services are available only to patients physically located in California at the time of an appointment. ## 4. No Physician-Patient Relationship Through the Site Using the Site, taking the Hormone Symptom Quiz, downloading content, scheduling a Discovery Call, or otherwise interacting with our online materials does not create a clinician-patient relationship. A clinician-patient relationship begins only after you have completed an Initial Comprehensive Consultation with Michele Missakian, MSPA-C; executed any required intake, informed consent, and HIPAA documentation; and been formally accepted into care. Until that time, all content on the Site is educational and informational in nature. See our Medical Disclaimer for additional information. ## 5. Services Description Core Function Health offers personalized consultations and continuing care programs in the areas of bioidentical hormone replacement, testosterone replacement, medical weight management, longevity therapy, thyroid optimization, and functional and preventive wellness. Treatment recommendations are individualized and offered only when medically appropriate and medically necessary. Not every patient qualifies for every therapy. ## 6. Fees, Payment, and Cancellations Current pricing is published on the Programs page and is subject to change with reasonable notice. Consultation and program fees are due at booking unless otherwise arranged. Laboratory testing, prescriptions, supplements, longevity therapies, medications, and specialty testing are billed separately. Payments are processed through Optimantra and other secure payment processors. Laboratory testing ordered by Core Function Health is non-refundable once ordered. Refund and rescheduling policies for consultations and programs are provided at booking. ## 7. Communications and Messaging If you submit your contact information through forms, quizzes, or scheduling tools, you consent to receive related communications from us. You may unsubscribe from marketing emails at any time. Routine email and Site form submissions are not secure and should not be used for sensitive health information outside our HIPAA-compliant patient portal. For clinical communications, please use the secure portal provided once you are an established patient. ## 8. Intellectual Property All Site content, including text, graphics, logos, images, the Core Function Health name and marks, the Hormone Symptom Quiz, and any educational materials, is the property of Core Function Health or its licensors and is protected by copyright, trademark, and other applicable laws. You may view and print Site content for personal, non-commercial use only. ## 9. User Conduct You agree not to use the Site for any unlawful purpose; submit false or impersonating information; attempt unauthorized access to our systems; interfere with the Site or its servers; use automated tools (bots, scrapers) to extract Site data; or upload viruses, malware, or other harmful code. ## 10. Third-Party Services and Links The Site references and may link to third-party services including Quest Diagnostics, Optimantra, Fullscript, and others. Those third parties have their own terms and privacy practices. We are not responsible for the content, products, services, or practices of any third party, and a link or reference does not constitute endorsement. ## 11. Disclaimers The Site and all content are provided "as is" and "as available." To the fullest extent permitted by law, Core Function Health disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. The Site is not a substitute for professional medical evaluation, diagnosis, or treatment. See our Medical Disclaimer for additional information. Limitation of Liability To the fullest extent permitted by law, Core Function Health and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, use, or goodwill, arising from or related to your use of the Site, even if advised of the possibility of such damages. Our total cumulative liability for any claim arising out of or relating to the Site (excluding clinical malpractice claims, which are governed by separately applicable law and professional liability coverage) shall not exceed the greater of one hundred US dollars or the fees you paid to us in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. ## 13. Indemnification You agree to indemnify, defend, and hold harmless Core Function Health and its officers, employees, agents, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third-party right. ## 14. Governing Law and Dispute Resolution These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts. ## 15. Changes to These Terms We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms. ## 16. Severability If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. ## 17.
